Who we are
Rakuneto is operated by Jean-Dominic Laroche, 77 rue Dugas, Québec, Québec, Canada, G1E 5H8, and provides the service at rakuneto.com. You can contact us at legal@rakuneto.com.
The service
Rakuneto is a private, bilingual pottery-studio notebook. It helps authorized studio members organize pottery, production, firing, market, inventory, and related studio information. Availability is currently limited to the pilot group. The service is currently offered without a subscription fee; no payment terms are created by these Terms.
Using Rakuneto
By creating an account, accepting an invitation, or using the service, you agree to these Terms. You must provide accurate account information, protect your account credentials, and promptly tell us about suspected unauthorized access. You may use the service only if you are at least 16 years old. If you use it for an organization, you confirm that you are authorized to agree to these Terms for it.
Your content and privacy
You keep ownership of content you enter or upload. You give Rakuneto a limited, non-exclusive licence to host, process, reproduce for backup, secure, and display that content only as needed to operate, maintain, and improve the service for you and the studio members you authorize. We do not acquire a right to sell, publicly distribute, or use your studio content for advertising. Our handling of personal information is described in the Privacy Policy.
You are responsible for your content. You must have the rights, permissions, and, where needed, consent to enter, upload, or share it through the service, including any personal information about another person.
Acceptable use
Use the service and its content features only for material reasonably connected to your studio's use of Rakuneto. You must not use the service to break the law; infringe another person's rights; enter, upload, store, or share content that is unlawful, harmful, or that you are not authorized to share; upload malicious code; send unsolicited commercial messages; impersonate another person; gain or attempt to gain unauthorized access; bypass or probe security controls or rate limits; use automated means to access the service except as we expressly permit; or interfere with the security, availability, or performance of the service.
Availability and changes
We may change, suspend, or discontinue all or part of the pilot service when reasonably necessary for security, legal compliance, maintenance, or product development. Where practical, we will provide reasonable notice of a material service change. You should export your studio information before scheduling permanent studio deletion.
Suspension and termination
We may suspend or terminate access when reasonably necessary to protect users or the service, address a material violation of these Terms, or comply with law. When appropriate, we will give notice and an opportunity to address the issue. You may stop using the service at any time and may schedule deletion of a studio through the service; the 30-day deletion process is described in the Privacy Policy.
Disclaimers and liability
The service is provided on an “as available” basis. To the extent permitted by law, Rakuneto does not make guarantees that the service will be uninterrupted, error-free, or suitable for a particular purpose. Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited, including applicable consumer-protection rights.
To the extent permitted by law, Rakuneto is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. This does not limit liability that cannot lawfully be limited.
Governing law and disputes
These Terms are governed by the laws of Québec and the applicable laws of Canada. Nothing in these Terms requires a consumer to submit a dispute to arbitration or prevents a consumer from going before a court or participating in a class action where the law permits. Courts with jurisdiction under applicable law may resolve a dispute.
Changes to these Terms
We may unilaterally amend only the contact information, security and technical requirements, acceptable-use rules, service features, and legal-compliance provisions of these Terms. We will not unilaterally amend the price, duration, or fundamental nature of the service except where permitted by applicable law.
If an amendment increases your obligations or reduces ours, we will send you a clear written notice at least 30 days before it takes effect. The notice will set out only the former and amended clause, the effective date, and your right to refuse the amendment and terminate the service without cost, penalty, or cancellation indemnity by written notice no later than 30 days after the amendment takes effect.
